Class Action Lawsuit Launched Against 407 ETR for $25 Million

“Stop the 407 ETR’s Abuse of Power” has great news.  We are one step closer to holding the 407 ETR accountable for the way they have been treating Ontarian’s.  A Class Action lawsuit has been launched against the 407 ETR for $25,000,000.00.  To quote the lawyers from Scarfone Hawkins’ press release, this lawsuit is “on behalf of all persons who incurred tolls and/or additional charges to 407 ETR who subsequently filed an assignment in bankruptcy and/or a proposal or consumer proposal under the BIA, and who later paid those tolls and/or additional charges to 407 ETR… the Statement of Claim alleges that 407 ETR unlawfully uses its Vehicle Permit renewal denial remedy to coerce payment of claims provable in bankruptcy which are subject to a Stay of Proceedings or were otherwise compromised and/or released by operation of the BIA.”  We are hopeful this will open the door for the rest of us who have been victimized by the 407 ETR’s misuse of the Plate Denial process.

 

I can personally attest to the fact that the 407 ETR has been given plenty of opportunity to sit down with us to make matters right, but their arrogance got in the way.  The 407 ETR has convinced themselves they are right even stating that they will defend themselves against this action because there are “cases” that support them.  These so-called “cases” they claimed supports them are under appeal by the Superintendent for Bankruptcy and this was the notice I put out to our group:

I am encouraging a good turn out in support of this case.     Are you aware of any lawsuits or class action suits or even attorneys in the Houston area of Texas that would be interested in helping victims of toll road authority abuse?
